Welcome to ArabiSouq! The terms "we", "us" and "our" refer to ArabiSouq. ArabiSouq operates this store and website, including all related information, content, features, tools, products and services, in order to provide you, the customer, with a curated shopping experience (the "Services"). ArabiSouq is powered by Shopify, which enables us to provide the Services to you.

The terms and conditions below, together with any policies referenced here (these "Terms of Service"), describe your rights and responsibilities when you use the Services. Please read them carefully, as they include important information about your legal rights and cover areas such as warranty disclaimers and limitations of liability.

By visiting, interacting with or using our Services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, you should not use or access our Services. These Terms of Service do not limit any rights you may have under applicable consumer protection laws or any other non-waivable statutory rights.

1. Access and account

By agreeing to these Terms of Service, you represent that you are at least 18 years old, and you have given us your consent to allow any of your minor dependents to use the Services on devices you own, purchase or manage. To use the Services, including browsing our online store or buying any of our products, you may be asked to provide certain information, such as your name, email address, phone number, and billing, payment and shipping information. You represent and warrant that all the information you provide is correct, current and complete and that you have all rights necessary to provide it. You are solely responsible for maintaining the security of your account credentials (if any) and for all activity on your account. You may not transfer, sell, assign or license your account to any other person.

2. Our products

We make every effort to represent our products accurately in our online store. However, colors or product appearance may differ from how they appear on your screen because of your device type and settings. We do not warrant that the appearance or quality of any product will meet your expectations or be exactly as depicted in our store. All product descriptions are subject to change at any time without notice. We reserve the right to discontinue any product at any time and may limit the quantity of any product we offer to any person, region or jurisdiction, on a case-by-case basis.

3. Orders

When you place an order, you are making an offer to purchase. ArabiSouq reserves the right to accept or decline your order for any reason, subject to applicable law. Your order is not accepted until ArabiSouq confirms acceptance.

For online payments, we must receive and process your payment before your order is accepted. For Cash on Delivery (COD) orders, payment is collected by the courier on delivery. We may contact you by phone call or WhatsApp to confirm your order before dispatch, and orders that cannot be confirmed may be delayed or cancelled.

Please review your order carefully before submitting, as we may be unable to accommodate cancellation requests after an order is accepted. If we do not accept, change or cancel an order, we may try to notify you using the email, address or phone number provided when the order was placed.

We may limit or refuse orders, including from customers who repeatedly refuse or fail to accept Cash on Delivery orders.

Your purchases are subject to return or exchange only in accordance with our Returns Policy. This does not limit any rights you may have under applicable law. You represent and warrant that your purchases are for your own personal or household use and not for commercial resale or export.

4. Prices and billing

Prices, discounts and promotions are subject to change without notice. The price charged for a product will be the price in effect when the order is placed and will be shown in your order confirmation. Prices are shown in AED. Delivery within the UAE is free unless stated otherwise on the product page or at checkout. We may offer promotions from time to time that are governed by separate terms; if a promotion's terms conflict with these Terms of Service, the promotion's terms apply.

You agree to provide current, complete and accurate purchase, contact and payment information for all orders, and to update it promptly so that we can complete your transactions and contact you when needed. You represent and warrant that (1) you are authorized to use any payment method you provide, (2) the information you provide for it is true, correct and complete, (3) charges you incur will be honored by your payment provider, and (4) you will pay all charges you incur at the posted prices, including any charges shown at checkout.

5. Shipping and delivery

Delivery times are estimates only and are not guaranteed. We are not responsible for delays caused by couriers, public holidays, weather or other events outside our control. Please see our Shipping Policy for details. Risk of loss passes to you when the order is delivered to you.

6. Intellectual property

Our Services, including all trademarks, brands, text, images, graphics, video and audio, are owned by ArabiSouq, its affiliates or licensors and are protected by UAE and international trademark, copyright and other intellectual property laws. The purchase or delivery of a product does not give you any intellectual property rights in the product, its design, software or underlying technology. These Terms permit you to use the Services for your personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works of, publicly display, republish, download, store or transmit any material on the Services without our prior written consent. ArabiSouq's names, logos, product names, designs and slogans are trademarks of ArabiSouq or its affiliates or licensors, and you must not use them without our written permission. Shopify's name, logo and related marks are trademarks of Shopify. All other names and logos on the Services belong to their respective owners. All rights not expressly granted are reserved.

7. Optional tools

You may be given access to tools offered by third parties as part of the Services, which we neither monitor nor control. We provide access to such tools "as is" and "as available", without any warranties or endorsement. We have no liability arising from your use of optional third-party tools, and you use them at your own risk. Any new features we add to the Services in the future are also subject to these Terms of Service.

8. Third-party links

The Services may contain links to websites provided or operated by third parties. We are not responsible for the content or accuracy of any third-party materials or websites. If you leave the Services to visit a third-party site, you do so at your own risk. We are not liable for any harm or damages related to your use of third-party websites or your purchases from them. Please review their policies before you engage in any transaction.

9. Relationship with Shopify

ArabiSouq is powered by Shopify. When you use the Services, your device communicates with Shopify's systems to deliver the Services. Any purchase you make in our store is made directly with ArabiSouq. Shopify is not responsible for any aspect of sales between you and ArabiSouq, including any injury, damage or loss resulting from purchased products.

10. Privacy policy

Our Privacy Policy explains how we collect, use and disclose personal information when you use the Services. By using the Services, you acknowledge that you have read it. Because the Services are hosted by Shopify, Shopify also collects, uses, processes and stores information about your access to and use of the Services, including transaction information, for purposes such as providing, securing and improving the Services and preventing fraud. 11. Feedback

If you send us ideas, suggestions, reviews or other content ("Feedback"), you grant us a perpetual, worldwide, royalty-free license to use, reproduce, modify, publish, distribute and display that Feedback in any medium for any purpose, including commercial use. You represent and warrant that you own or have all necessary rights to your Feedback and that it will not violate any third party's rights or contain unlawful, abusive or obscene content or malware. We are under no obligation to keep Feedback confidential, to pay for it or to respond to it, and we may monitor, edit or remove Feedback at our discretion. You are solely responsible for your Feedback and its accuracy. We take no responsibility for Feedback posted by you or any third party.

12. Errors, inaccuracies and omissions

Occasionally the Services may contain typographical errors or inaccuracies relating to product descriptions, pricing, promotions, offers, delivery times or availability. We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information or cancel orders if any information is inaccurate, at any time and without prior notice (including after you have submitted your order).

13. Prohibited uses

13.1 You may use the Services for lawful purposes only. You may not use them, directly or indirectly: (a) for any unlawful or malicious purpose; (b) to violate any international, UAE federal or local laws, rules or regulations; (c) to infringe our intellectual property rights or those of others; (d) to harass, abuse, insult, harm, defame or intimidate any person; (e) to transmit false or misleading information; (f) to send or upload any material that does not comply with these Terms; (g) to send spam, junk mail or chain letters; (h) to impersonate any person or entity; or (i) to engage in any other conduct that restricts anyone's use of the Services or may harm ArabiSouq, Shopify or other users.

13.2 In addition, you agree not to: (a) upload or transmit viruses or other malicious code; (b) reproduce, copy, extract, sell, resell or exploit any part of the Services; (c) collect or track the personal information of others; (d) spam, phish or pretext; (e) use any robot, spider, scraper, data-extraction tool, automated process or AI tool (such as agentic AI) to access the Services; or (f) interfere with or bypass the security features or access controls of the Services. We may suspend or terminate your access at any time, without notice, if we determine that you have violated these Terms.

14. Agents

14.1 This section applies if you use, allow or cause the deployment of an Agent to access or interact with the Services. "Agent" means any software or service that takes autonomous or semi-autonomous action on behalf of any person or entity, including on a person's device, without direct supervision.

14.2 No Agent may access or interact with the Services unless it identifies itself and follows section 14.4. No Agent may access the Services if we have asked it to stop.

14.3 We may limit, including by technical measures, whether and how any Agent accesses the Services.

14.4 Agents must: (a) identify themselves in every HTTP/HTTPS request by including "Agent/[agent name]" in the user agent string; (b) not hide that an interaction comes from an Agent, such as by mimicking human behavior or completing CAPTCHAs; (c) answer truthfully if asked whether they are a human or a computer; and (d) not circumvent any measure we use to block, limit or control Agents.

15. Termination

We may terminate this agreement or your access to the Services in our sole discretion at any time without notice, and you remain liable for all amounts due up to the date of termination. The following sections continue to apply after termination: Intellectual property, Feedback, Termination, Disclaimer of warranties, Limitation of liability, Indemnification, Severability, Waiver and entire agreement, Assignment, Governing law, Privacy policy, and any other provisions that by their nature should continue.

16. Disclaimer of warranties

The information on or through the Services is for general information only. We do not warrant its accuracy, completeness or usefulness, and any reliance you place on it is at your own risk.

EXCEPT AS EXPRESSLY STATED BY ARABISOUQ, AND TO THE EXTENT PERMITTED BY LAW, THE SERVICES AND ALL PRODUCTS OFFERED THROUGH THEM ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT ANY REPRESENTATION OR WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT GUARANTEE THAT YOUR USE OF THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE OR ERROR-FREE. NOTHING IN THESE TERMS LIMITS ANY RIGHTS YOU HAVE UNDER APPLICABLE CONSUMER PROTECTION LAW THAT CANNOT BE EXCLUDED.

17. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO CASE SHALL ARABISOUQ, OUR PARTNERS, DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, SERVICE PROVIDERS OR LICENSORS, OR THOSE OF SHOPIFY AND ITS AFFILIATES, BE LIABLE FOR ANY INJURY, LOSS, CLAIM, OR ANY DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL OR CONSEQUENTIAL DAMAGES OF ANY KIND, INCLUDING LOST PROFITS, LOST REVENUE, LOST SAVINGS, LOSS OF DATA OR REPLACEMENT COSTS, WHETHER BASED IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY OR OTHERWISE, ARISING FROM YOUR USE OF THE SERVICES OR ANY PRODUCTS PURCHASED THROUGH THEM, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

18. Indemnification

You agree to indemnify, defend and hold harmless ArabiSouq, Shopify, and our affiliates, partners, officers, directors, employees, agents, contractors, licensors and service providers from any losses, damages, liabilities or claims, including reasonable legal fees, payable to any third party arising out of (1) your breach of these Terms of Service, (2) your violation of any law or the rights of a third party, or (3) your access to and use of the Services. We will notify you of any such claim, and you agree to cooperate in the defense of it.

19. Severability

If any provision of these Terms of Service is found to be unlawful, void or unenforceable, it will be enforced to the fullest extent permitted by law, and the unenforceable part will be treated as removed. This does not affect the validity of the remaining provisions.

20. Waiver; entire agreement

Our failure to exercise or enforce any right or provision of these Terms of Service is not a waiver of that right or provision. These Terms of Service and any policies we post on this site are the entire agreement between you and us and replace any earlier agreements, communications and proposals, whether oral or written, including any earlier versions of these Terms.

21. Assignment

You may not transfer or assign this agreement or any of your rights or obligations under it without our prior written consent, and any attempt to do so is void. We may transfer or assign these Terms and our rights and obligations without notice to you.

22. Governing law

These Terms of Service and any separate agreements under which we provide you the Services are governed by and construed in accordance with the laws of the United Arab Emirates.

The headings in this agreement are for convenience only and do not limit or affect these Terms.

24. Changes to Terms of Service

You can review the most current version of these Terms of Service at any time on this page. We reserve the right, in our sole discretion, to update, change or replace any part of these Terms by posting changes on our website. It is your responsibility to check our website periodically for changes. Your continued use of the Services after changes are posted means you accept them.
